1. Overview

This website, elderwag.com, is operated by Elderwag ("Elderwag," "we," "us," or "our"). By visiting our site or buying from us, you agree to these Terms of Service ("Terms"), together with our Shipping Policy, Return & Refund Policy, and Privacy Policy. If you don't agree, please don't use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. We currently sell and ship to customers in the United States only.

3. Our products

We do our best to show product colors, sizes, and details accurately, but colors can look different on different screens and measurements may vary slightly. Please use the size guide on each product page before ordering.

Elderwag products are comfort and mobility aids for pets. They are not medical devices and are not meant to diagnose, treat, or cure any condition. If your dog has an injury, illness, or recent surgery, ask your veterinarian before using any support product. Always supervise your dog when using a harness, sling, boots, or socks for the first time.

4. Prices and availability

Prices are in US dollars and may change without notice. Products may sell out. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any order for that product and refund you in full, even after you receive an order confirmation.

5. Orders and payment

When you place an order, you're making an offer to buy. We may accept or decline any order. Your payment method is authorized at checkout and charged when your order ships.

By placing an order, you confirm that you are authorized to use the payment method you provide and that the billing information is accurate. To protect our customers, we review orders for fraud. We may contact you to verify an order, and we may cancel orders that appear fraudulent, unauthorized, placed with a mismatched billing address, or placed for resale. If we cancel an order, you will not be charged, or you'll be refunded in full.

6. Shipping, returns, and refunds

Shipping times, costs, and lost-package coverage are described in our Shipping Policy. Returns, exchanges, cancellations, and refunds are described in our Return & Refund Policy. Both are part of these Terms.

7. Payment disputes and chargebacks

If something is wrong with your order, please contact us at hello@elderwag.com before contacting your bank or card issuer. We reply within 1 business day and will work with you to resolve the issue quickly through a replacement or refund under our policies.

If you file a chargeback or payment dispute, we will respond to your card issuer or payment processor with the records of your transaction, which may include your order details, billing and shipping information, IP address and device information, carrier tracking and delivery confirmation, and our emails with you.

Filing a dispute for an order that was delivered as described, or for an item you keep without following our return process, is not a valid way to request a refund. If a dispute is decided in our favor, the original charge stands. We may refuse future orders from customers who file disputes that are not valid, and we may report fraudulent chargebacks to the appropriate authorities.

8. Accounts

If you create an account, you're responsible for keeping your login details secure and for all activity under your account. Let us know right away if you believe your account has been used without your permission.

9. Reviews and content you share

If you send us reviews, photos, videos, or comments, you confirm the content is yours and accurate, and you give Elderwag a non-exclusive, royalty-free license to use, display, and share it in connection with our store and marketing. We may remove any content at our discretion.

10. Intellectual property

All content on this site — including the Elderwag name, logo, text, graphics, and product images — belongs to Elderwag or its licensors and is protected by law. You may not copy, reproduce, or use it for commercial purposes without our written permission.

11. Prohibited uses

You agree not to use our site to break any law, place fraudulent orders, interfere with the site's security or operation, upload harmful code, scrape data, or misuse other people's information.

12. Disclaimer of warranties

Except as stated in our Return & Refund Policy, our site and products are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We don't guarantee that the site will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent permitted by law, Elderwag will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states don't allow these limitations, so they may not all apply to you.

14. Indemnification

You agree to hold harmless Elderwag from claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the site or our products.

15. Governing law

These Terms are governed by the laws of the State of Indiana and applicable US federal law, without regard to conflict-of-law rules.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the latest version. Changes apply to orders placed after they're posted.
